1. Acceptance of Terms

By accessing and using KeyTrace's website and services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service ("Terms") govern your use of our cryptocurrency recovery services, website, and any related services provided by KeyTrace ("we," "us," or "our"). By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Service Description

KeyTrace provides professional cryptocurrency recovery services, including but not limited to:

  • Lost wallet recovery
  • Forgotten password recovery
  • Seed phrase reconstruction
  • Hardware wallet recovery
  • Exchange account recovery assistance
  • Multi-signature wallet recovery
  • Smart contract interaction recovery

Our services are provided on a "no recovery, no fee" basis, meaning you only pay if we successfully recover your cryptocurrency assets. Success fees are calculated as a percentage of the recovered assets and will be clearly communicated before any recovery work begins.

3. User Responsibilities

By using our services, you agree to:

  • Provide accurate and complete information about your recovery case
  • Cooperate fully with our recovery process
  • Not use our services for any illegal or unauthorized purpose
  • Respect the intellectual property rights of KeyTrace and third parties
  • Maintain the confidentiality of any sensitive information shared during the recovery process
  • Verify your ownership of the cryptocurrency assets you are seeking to recover
  • Comply with all applicable laws and regulations, including anti-money laundering laws
  • Not attempt to reverse-engineer our proprietary recovery methods

You represent and warrant that you are the legitimate owner of the cryptocurrency assets you are seeking to recover. KeyTrace reserves the right to request verification of ownership and to refuse service if ownership cannot be satisfactorily established.

4. Service Limitations

While we strive to provide the best possible recovery services, we cannot guarantee successful recovery in all cases. Factors that may affect recovery success include:

  • The extent of data corruption or loss
  • The type of wallet or storage method used
  • The amount of information available about the lost assets
  • Technical limitations of current recovery methods
  • Blockchain-specific constraints and limitations
  • Security measures implemented by wallet providers
  • Time elapsed since the loss occurred

We will provide an honest assessment of recovery prospects during our initial consultation. KeyTrace reserves the right to decline cases where recovery prospects are deemed extremely low or impossible based on our professional assessment.

5. Intellectual Property Rights

The KeyTrace website and its original content, features, and functionality are owned by KeyTrace and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website without our prior written consent. Our recovery methodologies, tools, and techniques are proprietary and confidential, and any attempt to reverse-engineer, decompile, or discover the source code of our recovery tools is strictly prohibited.

6. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information when you use our services. By using our services, you agree to the collection and use of information in accordance with our Privacy Policy.

We implement appropriate security measures to protect your personal information and maintain strict confidentiality regarding your recovery cases. 7. Disclaimer and Limitation of Liability

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

In no event shall KeyTrace, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use our services
  • Unauthorized access to or alteration of your data
  • Statements or conduct of any third party on our service
  • Any unsuccessful recovery attempts
  • Any delay in providing services
  • Any matter related to our services

Our total liability to you for all claims arising from or related to the services shall not exceed the amount paid by you to KeyTrace for the specific service giving rise to the liability. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain types of damages, so some of the above limitations may not apply to you.

8. Indemnification

You agree to indemnify, defend, and hold harmless KeyTrace, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms by you, including but not limited to any claim related to your violation of any rights of another person or entity, providing false information, or violating any applicable laws or regulations.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms or our services shall be brought exclusively in the federal or state courts located in Delaware, and you hereby consent to the personal jurisdiction and venue of such courts.

For users residing in the European Union, these Terms shall be governed by and construed in accordance with the laws of your country of residence, and any disputes will be subject to the non-exclusive jurisdiction of the courts of your country of residence.

10. Dispute Resolution

Any disputes arising out of or relating to these Terms or our services shall first be attempted to be resolved through good faith negotiations. If such negotiations fail, and except where prohibited by applicable law, you agree that any claim or dispute you may have against KeyTrace must be resolved by binding arbitration in accordance with the rules of the American Arbitration Association.

The arbitration shall be conducted in English and shall take place in Delaware, or another location mutually agreed upon by the parties. The arbitration award shall be final and binding on the parties, and judgment on the award may be entered in any court of competent jurisdiction.

Before initiating arbitration, we encourage you to contact us directly to resolve any concerns. We are committed to working with our clients to address any issues promptly and fairly.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Your continued use of our services after any such changes constitutes your acceptance of the new Terms. If you do not agree to the revised Terms, you must stop using our services.

12. Force Majeure

KeyTrace shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic, epidemic, war, terrorism, riots, civil unrest, government actions, labor disputes, internet or telecommunications failures, power outages, or blockchain network disruptions.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.
